Please read these Terms and Conditions carefully and ensure you understand them before using the Services. By using the Services, you agree to be bound by these Terms and Conditions. If you continue to use the website or place an order for products, we will consider this as your acceptance of these Terms and Conditions.


General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "GTCS") are entered into between:

Hors-d'Oeuvre Éditions, a sole proprietorship registered under the SIRET number 7979 3384 3000 55 and whose registered office is located at 51, rue de l’Hôtel Dieu - 30900 Nîmes (France), represented by Alexandra Denat, hereinafter referred to as the "Seller",

and

Any individual or legal entity wishing to make a purchase via the website www.hors-doeuvre.fr, hereinafter referred to as the "Customer".
Purpose of the GTCS
These GTCS aim to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller, namely limited edition objects, original works, or any other product published by Hors-d'Oeuvre Éditions.


1. Products

The essential characteristics of the products, including dimensions, materials used, and production techniques, are presented on the website. Each product is published in a limited edition and is accompanied by a certificate of authenticity, if applicable.
Photographs of the products on the website are as accurate as possible but are not contractually binding.


2. Prices

The prices of the products are indicated in euros, including all taxes (VAT included), excluding delivery charges. The Seller reserves the right to modify the prices at any time, but the products will be billed based on the rates in effect at the time of the Customer's order validation.


3. Order

The Customer can place an order directly on the website by selecting the desired products and following the order process.
The order is confirmed when the Customer receives an order summary email from Hors-d'Oeuvre Éditions. The Seller reserves the right to cancel or refuse any order in case of dispute with the Customer or non-payment.


4. Payment

Payment for the products is made online via the following methods:
• Credit card (Visa, MasterCard, etc.)

The total amount of the order, including delivery costs, is due immediately upon order confirmation.


5. Delivery

The products are shipped within 2-3 weeks from the confirmation of the order for in-stock products, 4-5 weeks for made-to-order products, and 6-7 weeks for pre-orders.
The delivery costs are the responsibility of the Customer and vary based on the delivery location. Hors-d'Oeuvre Éditions offers free shipping for orders exceeding €150, both within France and internationally.
In case of delivery delay, the Seller agrees to inform the Customer as soon as possible.

If the package cannot be delivered due to the Customer's refusal to pay import duties and taxes, or if the package is returned to the Seller for other reasons outside of the Seller's control:

  • The Customer may request re-shipment by paying the shipping costs again (or the original shipping cost if free shipping was applied), or

  • The Seller will refund the amount of the product, minus the actual shipping costs incurred.

If the Customer does not respond within 15 days of the package being returned to the Seller, the product will no longer be refundable, including the shipping costs.


6. Right of Withdrawal

In accordance with the applicable legal provisions, the Customer has a period of 14 days from the receipt of the products to exercise their right of withdrawal, without having to provide any reason or pay penalties.
To exercise this right, the Customer must contact Hors-d'Oeuvre Éditions by email at the following address sales@hors-doeuvre.fr. The return costs are the responsibility of the Customer, except in cases of product defect or non-conformity.


7. Returns and Refunds

Returned products must be in perfect condition and in their original packaging. Once the return is accepted, Hors-d'Oeuvre Éditions agrees to refund the Customer within 14 days of receiving the returned products.


8. Warranties

The products sold are covered by the legal guarantees of conformity and against hidden defects in accordance with Articles 1641 et seq. of the French Civil Code.
In the event of a defect or hidden defect, the Customer may return the product to Hors-d'Oeuvre Éditions and request a replacement or refund, in accordance with legal provisions.


9. Personal Data

The information collected when placing an order is necessary for the management of orders and the customer relationship. It is processed in compliance with the applicable regulations, particularly the General Data Protection Regulation (GDPR).
The Customer has the right to access, correct, and delete their personal data. They may exercise this right by contacting Hors-d'Oeuvre Éditions at the following address: contact@hors-doeuvre.fr.


10. Intellectual Property

All elements present on the Hors-d'Oeuvre Éditions website (texts, images, graphics, logos) are protected by copyright and trademark laws. Any unauthorized reproduction or use of these elements is prohibited.


11. Liability

Hors-d'Oeuvre Éditions shall not be held liable for any indirect damages resulting from the purchase of products via the website, including, but not limited to, loss of business, loss of profit, or loss of data.
In the event of the inability to fulfill an order, Hors-d'Oeuvre Éditions' liability will be limited to the refund of the amounts paid by the Customer.


12. Applicable Law and Disputes

These GTCS are governed by French law. In the event of a dispute, the Customer is invited to contact the customer service department of Hors-d'Oeuvre Éditions at the following address: sales@hors-doeuvre.fr.
If no amicable solution is reached, the parties agree that the dispute will be submitted to the competent French courts of the jurisdiction where the Seller's registered office is located.



These General Terms and Conditions of Sale (GTCS) were updated on 21/10/2024 and are effective from that date.
